RANCHI, India, April 9 -- Jharkhand High Court issued the following order on March 9:

1. The applicant who is in custody since 24.05.2023 has renewed the prayer for grant of regular bail in connection with S.T. Case No.240 of 2023 arising out of Dumri P.S. Case No.16 of 2023, corresponding to G.R. Case No.381 of 2023, registered for the offence under Section 302 of the Indian Penal Code and charge sheet has been submitted under Section 302 of IPC and Sections 3/4 of the Prevention of Witch Craft (Daain) Practices Act, pending in the court of learned Addl. Sessions Judge-V, Gumla.

2. It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part.

3. Earlier the bail application of this applicant was rejected twice on merit by the Co-ordinate Benches of this Court vide order dated 11.06.2024 passed in B.A. No.11277 of 2023 and order dated 22.01.2025 passed in B.A. No.8306 of 2024. This is the third attempt.

3. Innocence has been claimed and undertaking has been given for participation in the trial. It has been submitted by the learned counsel for the applicant that most of the co-accused persons have already been enlarged on bail. It has been further submitted that he is entitled for fair trial and till date only 07 witnesses have been examined out of 11 witnesses. The examined witnesses has stated nothing specific against this applicant. On above basis, prayer for bail has been made.

4. Learned A.P.P. has opposed the prayer for bail of the applicant.

5. Considering the above facts and the period of custody, I am inclined to enlarge the applicant on bail. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-V, Gumla in connection with S.T. Case No.240 of 2023 arising out of Dumri P.S. Case No.16 of 2023, corresponding to G.R. Case No.381 of 2023, subject to condition that the applicant will submit self-attested copy of his Aadhaar Card and also give his mobile number before the learned trial court which he will not change during pendency of this case without prior permission of the court.
