RANCHI, India, June 12 -- Jharkhand High Court issued the following order on May 11:

1. Heard the learned counsel representing the petitioner and the learned counsel representing the respondents.

2. The petitioner approached this Court praying therein to direct the respondents to provide certified copy of Encroachment Case No. 60 of 2001 along with order contained in Memo No. 328 dated 04.05.2001.

3. It is the grievance of the petitioner that inspite of making applications, the respondents have not handed over the certified copy of the said documents to the petitioner.

4. This is surprising that many cases have been filed and has been brought to the notice of the Court where inpite of filing of proper application and demanding certified copy of documents, the State has failed to provide the same.

5. This Court fails to understand that when certified copy of some document is sought for by any applicant why the State is not providing it to him for which he was forced to approach the High Court by filing an application under section 226 of the Constitution.

6. Thus, I direct the Deputy Commissioner, Giridih to look into the matter and ensure that the certified copy of the Encroachment Case No. 60 of 2001 along with order contained in Memo No. 328 dated 04.05.2001 is supplied to the petitioner.

7. The petitioner should approach the Deputy Commissioner, Giridih within two weeks from today. It is expected that within two weeks thereafter certified copy would be made available to the petitioner.

8. It is made clear that if some additional folios/stamps/court fees are to be furnished, the petitioner will be informed in advance. The petitioner will cooperate with the authorities by depositing the aforesaid fees.

9. Accordingly, this writ petition is disposed of.
