RANCHI, India, Jan. 14 -- Jharkhand High Court issued the following order on Dec. 15:

1. Heard the parties.

2. Candidature of the petitioner for the post of Chowkidar has been rejected. The ground of rejection is that the petitioner does not belong to the same "Beat".

3. In the counter affidavit also the respondents have taken the same plea that since the petitioner does not belong to the same "Beat", he was disqualified.

4. The issue as to whether the petitioner should be resident of the same "Beat" for seeking appointment has already been set at rest by the Division Bench of this Court in WP(S) No. 1498 of 2025 and analogous cases. It has been held that it is not a mandatory provision. Persons from the nearby "Beat" can also be appointed. In the aforesaid judgment it has been held that the appointment has to be made district-wise which is the Rule. As per paragraph 28 persons from the adjoining "Beat" can also be appointed.

Considering the said judgment, I am inclined to set aside the impugned order dated 13.09.2025 and remit the matter to the respondents to reconsider the case of the petitioner in view of the judgment of the Division Bench of this Court in in WP(S) No. 1498 of 2025 and analogous cases and pass an appropriate order preferably within four weeks from the date of receipt of the copy of this order.

6. If it is found that the petitioner is otherwise entitled to be appointed, appointment letter should be extended to the petitioner.

7. Accordingly, this writ petition is disposed of.
