RANCHI, India, Sept. 25 -- Jharkhand High Court issued the following order on Aug. 25:

1. It appears from the document as appended in the case record that the present matter has been assigned to Hon'ble D.B-I, but as per the roster the present case has been listed today on the Board of this Court and, as such, the matter is being heard.

2. This writ petition is under Article 226 of the Constitution of India seeking for the following reliefs: -

"(a) For issuance of an appropriate writ(s)/order(s)/ direction(s) particularly a writ in the nature of certiorari for quashing the order dated 25.03.2021 passed by Deputy Commissioner, Sahibganj (Respondent No. 3), whereby the application made by the petitioner for renewal of stone mining lease has been rejected and the said order dated 25.03.2021 has never been supplied to the petitioner;

(b) For issuance of an appropriate writ(s)/order(s)/ direction(s) particularly a writ in the nature of certiorari for quashing the letter dated 26.03.2021 (Annexure-7) issued by the District Mining Officer, Sahibganj (Respondent No. 4) whereby the respondent no. 4, District Mining Officer, Sahibganj, has communicated the order passed by the Deputy Commissioner, Sahibganj (Respondent No. 3) regarding the rejection of renewal of stone mining lease granted to the petitioner;"

At the outset, the learned counsel appearing for the State has raised objection on the maintainability of the present writ petition by saying that the issue involved in the present case is similar to the issue involved in W.P(C) No.3560 of 2025 which was dismissed vide order dated 08.08.2025 passed by a co-ordinate Division Bench of this Court and, as such, this case is fit to be dismissed in view of the Rule as amended by insertion of provision of Rule 9(d), Rule 9(ch), and other allied provisions by virtue of amendment inserted in 2017 under the Jharkhand Minor Mineral Concession Rules, 2004.

4. Accordingly, in view of the order dated 08.08.2025 passed in W.P(C) No.3560 of 2025 by a co-ordinate Division Bench of this Court, the instant writ petition stands dismissed.

5. Pending interlocutory application(s), if any, stands disposed of.
