Heard the learned counsel for the respective parties.
This application has been preferred by the appellant for condoning a delay of 22 days in filing the appeal.
Having been satisfied with the reasons assigned in this application, the delay of 22 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of.
Cr. Appeal (DB) No. 1281 of 2025
This appeal is directed against the order dated 28.07.2025 passed by the learned Judicial Commissioner, Ranchi in B.P. No. 951 of 2025, arising out of Kanke PS Case No. 226 of 2021, whereby and whereunder, the prayer for bail of the appellant has been rejected.
Several persons were apprehended from a Scorpio vehicle and arms and ammunitions were recovered from the said vehicle.
Submission has been advanced by the learned counsel for the appellant that he has been implicated on the confessional statement of co-accused Afroz Ansari. It has been submitted that no incriminating material was recovered from the possession of the appellant and he is in custody since 10.05.2025. It has also been submitted that one of the coaccused similarly situated Md. Arshad has been granted bail by a coordinate Bench of this Court in Cr. Appeal (DB) No. 230 of 2024.
Learned A.P.P. has opposed the prayer for bail of the appellant.
On consideration of the manner of implication of the appellant and the fact that one of the similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court as noted above, we while setting aside the order dated 28.07.2025 passed by the learned Judicial Commissioner, Ranchi in B.P. No. 951 of 2025, arising out of Kanke PS Case No. 226 of 2021, direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Ranchi in connection with Kanke PS Case No. 226 of 2021.
This appeal is allowed.
