RANCHI, India, Dec. 17 -- Jharkhand High Court issued the following order on Nov. 17:

Heard the learned counsel for the respective sides.

This appeal is directed against the order dated 18.09.2025 passed by the learned Additional Sessions Judge-I-cum-Spl. Judge, Gumla in ABP No. 388/2025 in connection with Ghaghra (AHTU) PS Case No. 18/2021, whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected.

It has been alleged that daughter of the informant was sold by Kalash Devi and Jitiya Oraon about ten years back and despite the informant making a search for her daughter she could not be traced out.

Submission has been advanced by the learned counsel for the appellant that the name of the appellant has subsequently transpired in course of investigation on the confessional statement of co-accused Jitiya Oraon who has been granted regular bail by the learned trial Court. It has been submitted that the appellant does not have any connection with the trafficking of the victim and in fact, he does not have any criminal antecedent.

Learned Spl.P.P. has opposed the prayer for anticipatory bail of the appellant.

On consideration of the fact that the name of the appellant had transpired on the confessional statement of Jitiya Oraon and in absence of any other incriminating materials against the appellant, we while setting aside the order dated 18.09.2025 passed by the learned Additional Sessions Judge-Icum-Spl. Judge, Gumla in ABP No. 388/2025 in connection with Ghaghra (AHTU) PS Case No. 18/2021, direct the appellant to surrender before the learned trial court within four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I-cum-Spl. Judge, Gumla in connection with Ghaghra (AHTU) PS Case No. 18/2021, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.

This appeal is allowed.
