JHARKHAND HIGH COURT ISSUES ORDER ON RAMNANDAN SAW V/S THE STATE OF JHARKHAND

RANCHI, India, June 12 -- Jharkhand High Court issued the following order on May 11:

11. Heard the parties.

2. The petitioner, in this writ petition, prays for following relief:-

"1. For issuance of appropriate writ(s)/ order(s)/ direction(s), particularly in the nature of mandamus, commanding upon the concerned respondents specially respondent No.4. i.e., the Circle Officer, Balumath to expedite the representations of the petitioner which has been duly received in the office of the Circle Officer, Balumath on 12.04.2021, which was received on 12.04.2021, in connection with issuance of online rent receipt with respect to Mauja Ara, Thana No.55, Circle Balumath, Dist-Latehar, Khata Number and Kheshra number of the same has been mentioned in the order of the Revenue Officer pursuant to common order passed in favour of the petitioner by the Revenue Officer Latehar in Revenue Case No.3061/1990, vide its order dated 08.07.2019, which has been kept pending without any rhyme and reason and as per the knowledge of the petitioner there is no any legal impediment for the issuance of the same with respect to the Khata number and kheshra numbers referred herein.

3. Learned counsel for the petitioner submits that he has already represented before the Circle Officer, Balumath but no action has been taken. He submits that suffice it would be if a direction is given to the respondents to dispose of the application of the petitioner.

4. Learned counsel appearing on behalf of the State submits if the matter is still pending, appropriate order will be passed as per law, considering the records.

5. After hearing the parties, I direct the petitioner to file a fresh representation before the Circle Officer, Balumath, respondent No.4, within four weeks. On receipt of the said representation, the case of the petitioner will be considered by the Circle Officer, Balumath within a period of eight weeks. If it is found that the petitioner's claim is genuine, appropriate action will be taken.

6. If the claim of the petitioner is rejected, reasoned order will be communicated to him within the aforesaid period.

7. With the aforesaid observations, this writ petition stands disposed of.
