RANCHI, India, Dec. 19 -- Jharkhand High Court issued the following order on Nov. 19:
This appeal is directed against the order dated 08.10.2025 passed in B.P. No. 376 of 2025 in connection with Balumath P.S. Case No. 229/2020 (G.R. No. 756 of 2025) by the learned Additional Sessions Judge-III, Latehar, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It has been alleged that there was an exchange of firing between the police personnel and the extremists and being out maneuvered the extremists had fled away and on search of the place of occurrence several incriminating articles were recovered.
Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on account of the allegation that the extremists were taking the names of each other at the time of fleeing away from the place of occurrence. Learned counsel adds that the appellant is in custody since 24.06.2025 and one of the co-accused Kaltu Ganjhu @ Mjinder @ Laldeep Ji @ Laldip Ganjhu @ Kartik Ganjhu has already been granted bail by a Coordinate Bench of this Court in Cr. Appeal (DB) No. 630 of 2024.
Learned Spl.PP though has opposed the prayer for bail of the appellant, but and has not disputed the aforesaid facts.
Regard being had to the manner of implication of the appellant, we while setting aside the order dated 08.10.2025 passed in B.P. No. 376 of 2025 in connection with Balumath P.S. Case No. 229/2020 (G.R. No. 756 of 2025) by the learned Additional Sessions Judge-III, Latehar, direct that the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Balumath P.S. Case No. 229/2020 (G.R. No. 756 of 2025).
This appeal is allowed.
