RANCHI, India, Dec. 31 -- Jharkhand High Court issued the following order on Dec. 1:
1. Heard the parties.
2. As submitted by the learned counsel for the petitioners the issue involved in this case fell for consideration before the Division Bench of this Court in WP(S) No. 4425 of 2023.
3. He also fairly submits that in WP(S) No. 4425 of 2023 titled "Sanjay Pater Munda vs. The State of Jharkhand" the Division Bench has held that Rule of 2022 repealed the Rule of 2012. It has also been held that once old Rule is repealed all the appointments, even if vacancies arose before promulgation of the new rules must be filled up in accordance with the new Rules.
4. It was also held that once the appointing Authority decides to fill up the post, the vacancies, which arose prior to the new Rules, must be filled up with the fresh Rules.
5. Considering the aforesaid, the Division Bench dismissed the writ petition.
6. Considering the judgment passed by the Division Bench in "Sanjay Pater Munda" (supra), this Court also dismissed similar writ application being WP(S) No. 740 of 2025.
7. It has been submitted in this case that this case is also covered by the judgment passed by the Division Bench in WP(S) No. 4425 of 2023.
8. Considering the aforesaid submission, this writ application is dismissed in terms of the judgment of the Division Bench of the Court in WP(S) No. 4425 of 2023.
