RANCHI, India, June 16 -- Jharkhand High Court issued the following order on May 14:

1. Heard learned counsels for petitioners and for State.

2. The petitioners are apprehending their arrest in connection with Deodanr PS Case No.6 of 2026, for offence registered under section 140(2), 3(5) of BNS, 2023, pending in court of learned Sub Divisional Judicial Magistrate, Godda.

3. Learned counsel for petitioners submits that after unloading the articles the Tempo in question was being returned which was being driven by Manish Kumar Jha and helper is Kundan Kumar Yadav which met with an accident by a motorcycle coming from opposite side and after seeing huge crowd assembled there, the driver ran away fearing fight and this fact has been disclosed in the FIR, however, false allegations are made of kidnapping the driver and demanding Rs.One lac and in the FIR itself it has been stated that driver has returned back on the same night. He next submits that the compromise has been taken place between the informant, driver, khalasi as well as the petitioners and on these grounds he submits that anticipatory bail may kindly be granted.

4. Learned State counsel opposes prayer and submits that allegations of kidnapping and demanding extortion money is there.

Considering that the driver has already returned on the same night who has fled away seeing the huge crowd assembled there and all that has happened due to trivial nature of accident as the motorcycle has hit the Tempo in question and further now the compromise has been taken place, and in the attending facts and circumstances of the present case, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before learned court within two weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned Sub Divisional Judicial Magistrate, Godda, in connection with Deodanr PS Case No.6 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
