RANCHI, India, Dec. 10 -- Jharkhand High Court issued the following order on Nov. 10:
1. The instant writ application has been filed by the petitioner for the following reliefs:
"That, by this writ application, the petitioner prays for issuance of writ(s), rule(s), order(s), observation(s), direction(s) in the nature of Certiorari for quashing the Memo No. 2517(23) dated 05.12.2016 passed by the Director -inChief Health Services, Government of Jharkhand, Ranchi (Annexure-11) by which issuance of regular appointment of the petitioner has been rejected, though, all the criteria of Notification No. 29(10) dated 30.01.2014 (Annexure4) has been fulfilled by the petitioner as per other similarly situated persons who have been appointed.
And
For issuance of writ(s), rule(s), order(s), observation(s), direction(s) in the nature of Mandamus commanding upon the Respondent Authorities for making arrangements forthwith for issuance of appointment letter in favour of the petitioner for the post of Grade A Nurse as the other similarly situated persons have been appointed and she is in merit list at Sl. No. 80 (Annexure -7) made under the Notification No. 29(10) dated 30.01.2014 (Annexure-4) and fulfilled all the conditions there under.
And
For issuance of such other writ(s), rule(s), order(s), observation(s), direction(s) to which Your Lordships may deem fit and proper to make conscionable justice to the petitioner upon the facts and circumstances of this case."
2. No one appears for the Petitioner, however, Mr. Binit Chandra, learned counsel, representing the Respondents submits that the case was pending on the ground that similar matter being W.P.(S) No. 2641 of 2016 was pending before the Division Bench of this Court and the Division Bench of this Court has decided the issue against the Petitioner. As such, the instant writ application may be dismissed.
3. Having heard learned counsel for the Respondents and after perusing the records of the case, it appears that on 07.11.2022, there was an order by this Court to list this case after disposal of W.P.(S) No. 2641 of 2016 and since the said case has been disposed of, the instant case has been listed today.
4. After perusing the order dated 04.09.2023 passed in W.P.(S) No. 2641 of 2016 it appears that the Division Bench of this Court has held that the Petitioners have no right to continue on the post and ask for regularization.
