RANCHI, India, Sept. 23 -- Jharkhand High Court issued the following order on Aug. 22:
1. Heard learned counsel representing the petitioners and learned counsel representing the respondents.
2. By filing this writ petition, the petitioner claims enhancement in his salary by 20% along with the consequential benefits and arrears thereof.
3. After going through the prayer, I find that first it has to be decided as to whether the petitioner is entitled for the benefit or not, for which several factual aspects are necessary to be taken note of.
4. Learned counsel representing the petitioner submits that suffice it would be, if the representation of the petitioner will be disposed of and the petitioner be given an opportunity to place all the materials before the concerned Authority.
5. Considering the aforesaid submission, I direct the petitioner to file a fresh representation along with relevant documents before the concerned respondent, within four weeks.
6. If such representation is filed, the concerned respondent will consider the case of the petitioner and will decide the same within a period of six weeks.
7. If the petitioner is found entitled to, the monetary benefits should be extended to him within four weeks thereafter.
8. If any part of the claim / representation is rejected, a reasoned order should be communicated to the petitioner.
9. With the aforesaid directions, this writ petition stands disposed of.
