RANCHI, India, Jan. 14 -- Jharkhand High Court issued the following order on Dec. 15:
1. Learned Counsel appearing for the writ petitioner, on instruction, has submitted that since the period of detention order has already elapsed and as such, he does not intend to press this writ petition for the present. However, he has sought for liberty to challenge, in a case, if any, further order by way of fresh extension order extending the period of detention if passed liberty may be reserved to challenge the same by filing fresh writ petition.
2. There is none to oppose on behalf of the State.
3. Considering the submission made on behalf of the writ petitioner, this Court is of the view that the detention order since has lost its force and as such nothing remains to be decided in this writ petition and as such as is being prayed to withdraw the writ petition, such liberty is being granted for withdrawal of the writ petition by reserving liberty to the writ petitioner to challenge the order, if any, passed afresh or extending the period of detention which is the subject matter of the present writ petition.
4. Accordingly, the writ petition stands dismissed as withdrawn with the aforesaid observation.
