RANCHI, India, Sept. 15 -- Jharkhand High Court issued the following order on aUG. 18:

1. The instant case was earlier sent for mediation by the order passed by this Court on 17.07.2025. As per the mediation report received vide Letter dated 01.08.2025, the matter appears to have been settled in between both the sides. The terms of the settlement have been enclosed with the mediation report duly signed by learned counsel for the parties.

2. It is submitted by learned counsel for the appellant- Insurance Company that dispute has been settled between the parties as per the terms of the settlement under the following conditions :-

1) Respondent agreed that she received amount of Rs.4 Lakhs (Four Lakhs) and Appellant (Oriental Insurance Co. Ltd.) agreed to pay further five lakh Rupees to the Respondent in which Respondent agreed to receive the said amount.

2) That Respondent shall not further claim any compensation in respect of this case.

3. It is submitted by learned counsel for the appellant that in compliance to the order passed by the Co-ordinate bench of this Court in this case on 27.10.2016, Rupees Ten Lakhs were deposed by the appellantInsurance Company before the Certificate Officer, Godda against the awarded compensation amount.

4. In this view of the matter, the learned MACT shall ensure that balance of Rs.5 Lakhs is paid to the claimant(s) from the amount already deposited by the appellant- Insurance Company with the Certificate Officer, Godda and the rest amount of Rs.1 Lakh to be refunded to the appellant- Insurance Company.

The instant Misc. Appeal is accordingly disposed of, in terms of the settlement.

5. The statutory amount deposited at the time of filing of the instant Misc. Appeal shall be refunded to the appellant- Insurance Company at the earliest.
