RANCHI, India, Sept. 23 -- Jharkhand High Court issued the following order on Aug. 22:
1. Heard learned counsel representing the petitioner and learned counsel representing the respondents.
2. It is the case of the petitioner that he has not been paid the MACP, though the respondents have accepted that the petitioner is entitled for the 1st ACP / MACP w.e.f. 29.11.2009 in the pay scale of Rs.5,200 - 20,200/-, Level-2, with Grade Pay of 1,900/- and 2nd MACP from 29.11.2019 in the pay scale of Rs.5,200 - 20,200/- with Grade Pay of 2,000/- in Level-3.
3. Learned counsel representing the petitioner submits that the petitioner has already filed a representation before respondent Authority but no action has been taken. It is his prayer that suffice it would be, if a direction is given to respondent No.2 - The Director, Hasthkargha Resham and Hastshilp, Jharkhand, to consider the case of the petitioner and pass a reasoned order.
4. Considering the aforesaid submission, I direct the petitioner to file a fresh representation along with all the relevant documents in his favour, before respondent No.2 - The Director, Hasthkargha Resham and Hastshilp, Jharkhand, within four weeks.
5. On receipt of such representation, the concerned respondent will consider the case of the petitioner and will decide the same within a period of six weeks.
6. If the petitioner is found entitled to, the monetary benefits should be extended to him within four weeks thereafter.
7. If any part of the claim / representation is rejected, a reasoned order should be communicated to the petitioner.
8. With the aforesaid directions, this writ petition stands disposed of.
