RANCHI, India, June 6 -- Jharkhand High Court issued the following order on May 6:

Heard Mr. Rohit Ranjan Sinha, the learned counsel for the appellant and Mr. Vineet Kumar Vashistha, the learned Spl.P.P. for the State.

This appeal is directed against the order dated 17.05.2024 passed in MCA No. 130 of 2024 in connection with ST Case No. 28 of 2024, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that there was an exchange of firing between the police personnel and the extremists. One of the extremists, namely, Bandhu Hassa Purty was apprehended and from his possession one loaded country made pistol along with several cartridges and other incriminating materials were recovered. So far as Bandhu Hassa Purty is concerned, he has been granted bail by this Court in Criminal Appeal (DB) No. 55 of 2023. The name of the appellant has surfaced on the confessional statement of the apprehended accused. The appellant is in custody since 26.09.2022.

Regard being had to aforesaid facts, we while setting aside the order dated 17.05.2024 passed in MCA No. 130 of 2024 in connection with ST Case No. 28 of 2024 direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge-III, Khunti in ST Case No. 28 of 2024.

This appeal is allowed.
