RANCHI, India, June 16 -- Jharkhand High Court issued the following order on May 14:
1. Heard learned counsels for petitioners and for State.
2. The petitioners are apprehending their arrest in connection with Complaint Case No.485 of 2021, for offence registered under section 33(i),(a),(c) of Indian Forest Act 1927, pending in court of learned Judicial Magistrate First Class, Giridih.
3. Learned counsel for petitioners submits that falsely the petitioners have been implicated in this case alleging therein that the petitioner were excavating in the forest area. He next submits that the said allegations are false and how the petitioners are involved in the said excavation that is not disclosed in the offence report and the petitioners have got no criminal antecedent as disclosed in paragraph no.13 of the petition.
4. Learned State counsel opposes prayer and submits that the petitioners are named in the offence report.
5. Considering that the villagers have said to be disclosed the name of the petitioners, however, the names of the villagers who have taken the name of these petitioners are not disclosed in the offence report and even the said excavation has been denied by these petitioners and the petitioners have got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to the petitioners.
6. Accordingly, both the petitioner, above named, are hereby directed to surrender before learned court within two weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned Judicial Magistrate First Class, Giridih, in connection with Complaint Case No.485 of 2021, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
