RANCHI, India, Dec. 31 -- Jharkhand High Court issued the following order on Dec. 1:
1. Heard the parties.
2. The petitioner has been made accused in connection with N.D.P.S. Case No. 44(A) of 2023 arising out of Saiko P.S. Case No. 20 of 2023, for the offences registered under Sections 15(c) & 25 of the N.D.P.S. Act, pending in the Court of learned Special Judge, NDPS, Khunti.
3. On 21.07.2023 at about 5:30 A.M., Saiko police seized the Mahindra Pick-up Van bearing registration no. JH01BB-5325 and Tata 709 Truck bearing registration No. JH02AC-4058. On search, 564 kgs. of poppy husk (doda) was found loaded in Mahindra Pick-up Van and 2066 kgs. of poppy husk (doda) was found loaded in Tata709 Truck.
4. It was submitted that petitioner was neither apprehended at spot nor anything was recovered from his possession. It was further submitted that registered owner of Tata 709 Truck bearing registration No. JH02AC-4058 has told the police that he had sold this vehicle to this petitioner and petitioner in turn sold the same vehicle to one Mahadeo Pahan. However, paper of agreement which was produced by the registered owner was found to be fake.
5. Learned Special P.P. has opposed the prayer for bail of the petitioner and has submitted that petitioner has confessed that he was driver of the said vehicle.

Considering the fact that petitioner was neither apprehended at spot nor he is registered owner of Tata 709 Truck bearing registration No. JH02AC-4058, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge, NDPS, Khunti in connection with N.D.P.S. Case No. 44(A) of 2023 arising out of Saiko P.S. Case No. 20 of 2023.
