Heard Ms. Diksha Rani, the learned counsel for the appellant and Mr. Sanjay Kumar Srivastava, the learned A.P.P.

This application has been preferred by the appellant for condoning a delay of 18 days in filing the appeal.

Having been satisfied with the reasons assigned in this application, the delay of 18 days which had occurred in filing this appeal is condoned and this I.A. is allowed and disposed of.

Criminal Appeal (DB) No. 1013 of 2025

This appeal is directed against the order dated 06.03.2025 passed in MCA No. 553/2025, arising out of Chhattarpur PS Case No. 28/2018 by the learned Additional Sessions Judge-VII, Palamau, whereby and whereunder, the prayer for bail of the appellant has been rejected.

It has been alleged that one Yogendra Bhuiyan who was an extremist was apprehended and on his confession several arms and ammunitions were recovered.

Submission has been advanced by the learned counsel for the appellant that the appellant has been implicated on the confession of coaccused Yogendra Bhuiyan. It has been submitted that the appellant is in custody since 04.07.2018.

Learned A.P.P. has opposed the prayer for bail of the appellant.

Regard being had to the manner of implication of the appellant and the period of custody undergone by him, we while setting aside the order dated 06.03.2025 passed in MCA No. 553/2025, arising out of Chhattarpur PS Case No. 28/2018 by the learned Additional Sessions Judge-VII, Palamau direct the appellant be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, Palamau, in connection with ST No. 72/2022, arising out of Chhattarpur PS Case No. 28/2018, corresponding to GR Case No. 567/2018.

This appeal is allowed.
