JABALPUR, India, March 25 -- Madhya Pradesh High Court issued the following judgment/order on Feb. 23:
1. Petitioners have filed this petition seeking a direction to the respondents to fill up the post of Middle School Teachers on the basis of Teacher Eligibility Test, 2018 in light of the rules than prevailing.
2. As per the petitioners, they had qualified Teacher Eligibility Test in the year 2018. He states that there are still seats available and as such based on the said eligibility test, the petitioners should be appointed. It is further stated that subsequently, in the year 2022, the rules were amended and Selection Test has been introduced. However, petitioners sought to be appointed as Middle School Teachers based on the fact that they had cleared Teacher Eligibility Test in the year 2018.
3. Subject petition has been filed in April, 2025, after a lapse of over 07 years of the petitioners qualifying the Teacher Eligibility Test. Subsequently, keeping in view the declining standards, the State Government introduced a Selection Test required to be qualified by Teachers seeking to be employed as Middle School Teachers in addition to the Teacher Eligibility Test.

We note that, on 29.9.2022, a public notice was issued by the State Government requiring all aspirants who had qualified the Teacher Eligibility Test prior to the amendment of the rules to seek their employment based on their having qualified the Teacher Eligibility Test. After the period was over, the rules were amended and Selection Test was introduced.
5. We note that petitioners have kept silent for over a period of 07 years, after qualifying Teacher Eligibility Test. They failed to even seek employment pursuant to the public notice dated 29.09.2022 requiring all aspirants who were desirous of being employed as per the than prevailing rules to seek employment.
6. We find no merit in the petition, the petition is accordingly dismissed.
