JABALPUR, India, Dec. 9 -- Madhya Pradesh High Court issued the following judgment/order on Nov. 10:
I.A. No.19616/2025 :
This is an application for condonation of delay of 174 days in filing the present MCC.
For the reasons stated in the application, delay in filing the MCC is condoned and IA stands allowed.
MCC No.3558/2025 : Petitioner seeks restoration of R.P. No.934/2024 which was dismissed for non-compliance of common conditional order dated 08.01.2025.
2. Learned counsel for the petitioner submits that the review petition was dismissed for non-compliance of the common conditional order due to fault of the counsel because the default pointed out by the Registry could not remove completely within time. When the counsel for the petitioner enquired about the case, he found that the case was dismissed for noncompliance of common conditional order. He further submits that the mistake is bonafide in nature and not intentional. Therefore, in view of the aforesaid circumstances, it would be appropriate in the interest of justice to restore the review petition to its original number for hearing.
3. In view of above submissions made by the counsel for the petitioner, R.P. No.934/2024 is restored to its original number.
4. Petitioner shall cure the defects, if any, within one week. 5. Accordingly, the MCC is disposed of. 6. Registry is directed to place the copy of this order along with the record of R.P. No.934/2024.
