JABALPUR, India, April 26 -- Madhya Pradesh High Court issued the following judgment/order on March 26:
Learned counsel for the petitioner submits that petitioner has already given a representation against the alleged wrongful termination of his contract. He further submits that the respondents have invited a bid for the balance work, however, the work executed by the petitioner till date has not been entered in the measurement book. He submits that he shall be satisfied in case a direction be issued to the respondents to measure the work already executed by the petitioner and entered the same in the measurement book. He reserves a right of the petitioner to raise a dispute before the appropriate forum in terms of the dispute resolution clause with regard to the payment for the work executed if not made by the respondents.

In view of the above, petition is disposed of with a direction to the respondents to decide the representation of the petitioner and also to measure the work already executed by the petitioner, if not already done, and enter the same in the measurement book before handing over the site for completion of the balance work to a third party contractor. It would be open to the petitioner to raise the dispute in accordance with the dispute resolution mechanism provided in the contract if petitioner is aggrieved by any action of the respondents. All rights and contentions of the parties are reserved.
