JABALPUR, India, Jan. 20 -- Madhya Pradesh High Court issued the following judgment/order on Dec. 19:

1. Petitioners have filed the subject petition seeking restoration of W.A. No.370/2021 with the delay of 1,203 days. The only contention of the petitioners is that the writ appeal which was filed in the year 2021 with certain defects and petitioners could not cure the defects in time.

2. The writ appeal was dismissed in terms of peremptory orders dated 09.06.2021 and 29.07.2021. Subject petition has been filed on 27.10.2025 with the delay of 1,203 days. We are not satisfied with the explanation given by petitioners with regard to delay in filing the restoration petition. It may further be noticed that petitioners seek restoration of the writ appeal which was filed on 26.03.2021 challenging an order dated 29.11.2005 i.e. with the delay of 15 years. Even in the application seeking condonation of delay, there is no explanation at all except to state that appellants are farmers and they could not visit Jabalpur to pursue the case.

3. There is contumacious delay in filing the restoration petition without any plausible explanation. We are not inclined to condone the delay and restore the writ appeal.

4. Accordingly, the application I.A. No.22467/2025 is dismissed. Consequently, the petition is also dismissed on the ground of delay.
