JABALPUR, India, Dec. 17 -- Madhya Pradesh High Court issued the following judgment on Nov. 17:
1. Petitioner had earlier filed writ petition being W.P.No.36132 of 2025 seeking the following prayer :
7.1. Issue a Writ in the nature of Certiorari or any other appropriate writ, order, or direction to quash and set-aside the impugned Qualifying Recruitment stipulated in Clause 04 of E-Auction Catalogue No.VJ25222335 (Annexure-P/1).
7.2. Issue a Writ in the nature of Mandamus or any other appropriate writ, order or direction, commanding the respondents to allow the petitioner and all other similarly situated bidders to participate in the said E-Auction Catalogue No.VJ25222335, based on the submission of the EMD, without the enforcement of the impugned arbitrary conditions;
7.3. Pass any other order or direction as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.
2. Said petition was dismissed on 15.09.2025 and, subject petition has been filed seeking the following prayer which are verbatim to the prayer earlier sought :-
7.1. Issue a Writ in the nature of Certiorari or any other appropriate writ, order, or direction to quash and set-aside the impugned Qualifying Recruitment stipulated in Clause 04 of EAuction Catalogue No.VJ25222335 (Annexure-P/1).
7.2. Issue a Writ in the nature of Mandamus or any other appropriate writ, order or direction, commanding the respondents to allow the petitioner and all other similarly situated bidders to participate in the said E-Auction Catalogue No.VJ25222335, based on the submission of the EMD, without the enforcement of the impugned arbitrary conditions;
7.3. Pass any other order or direction as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.
3. It is noticed that the subject petition was filed no 21.08.2025, whereas the writ petition no.36132 of 2025 was filed on 06.09.2022, which was dismissed on 15.09.2025. Since identical petition has already been considered and dismissed on merit arising out of same tender, this petition is not maintainable. Accordingly, the same is dismissed as not maintainable.
