JABALPUR, India, May 1 -- Madhya Pradesh High Court issued the following judgment/order on March 31:
It is an admitted position that the brother of the petitioner has a hotel where the subject flyover is being constructed. Since there is a private interest involved in the subject flyover, we are of the view that a public interest litigation petition would not be maintainable.
The petition is accordingly disposed of without prejudice to the right of the petitioner or the hotel owner to initiate appropriate proceedings in accordance with law.
