JABALPUR, India, May 1 -- Madhya Pradesh High Court issued the following judgment/order on March 31:
Learned counsel appearing for the respondent submits that the judgment dated 23.01.2024 passed in Writ Petition No.28013/2023 (Hempal Singhai Vs. The State of M.P. and others) based on which the impugned order has been passed, has been duly complied with by the State.
Learned Deputy Advocate General appearing on behalf of appellants/State submits that there are certain distinguishing features in the two cases and the aforesaid judgment is not squarely applicable to the facts of the present case. He submits that an erroneous statement was made before the Writ Court that this case is squarely covered by the said judgment. He seeks leave to withdraw the appeal reserving the right of appellants to approach the Writ Court by way of a review petition.
In view of the above, appeal is dismissed as withdrawn.
All rights and contentions of the parties are reserved.
