JABALPUR, India, Nov. 27 -- Madhya Pradesh High Court issued the following judgment/order on Oct. 29:
Appellant impugns order dated 02.07.2025 whereby writ petition filed by the appellant impugning order passed by the Labour Court dated 13.12.2024 has been dismissed.
We note that though appellant had filed a writ petition under Article 226 of the Constitution of India, the same was in the nature of petition under Article 227 of the Constitution of India impugning the order of Labour Court on merits.
Reference may be had to the decision of Full Bench of this Court in Shailendra vs. Div. Forest Officer, 2017(4) M.P.L.J, 109 wherein the Full Bench had held that intra-court appeal in such circumstances would not be maintainable.
In view of the above, learned counsel for appellant seeks leave to withdraw the appeal reserving the right of the appellant to initiate appropriate proceeding in accordance with law.
In view of the above, the appeal is dismissed as withdrawn.
All rights and contentions of the parties are reserved.
