MADHYA PRADESH HIGH COURT ISSUES ORDER ON C.P.MISHRA CONSTRACTORS V/S THE STATE OF MADHYA PRADESH AND OTHERS CASE

JABALPUR, India, Aug. 27 -- Madhya Pradesh High Court issued the following judgment/order on July 28:

Learned Additional Advocate General raises a preliminary objection that the disputes raised by the petitioner are liable to be referred to arbitral Tribunal under the Madhya Pradesh Madhyastham Adhikaran Adhiniyam, 1983.

Faced with the objection, learned counsel for petitioner seeks leave to withdraw the petition reserving the right of the petitioner to approach the arbitral Tribunal under the Madhya Pradesh Madhyastham Adhikaran Adhiniyam, 1983 and to take steps in accordance with dispute resolution clause.

In view of the above, the petition is dismissed as withdrawn.

All rights and contentions of the parties are reserved.
