JABALPUR, India, Jan. 3 -- Madhya Pradesh High Court issued the following judgment/order on Dec. 2:

This is an application for condonation of delay of 204 days in filing the present MCC.

For the reasons stated in the application, delay in filing the MCC is condoned and IA stands allowed.

MCC No.2845 of 2025

Petitioner seeks restoration of W.A.No.2390/2023, which was dismissed for non-compliance of common conditional order dated 08.11.2024.

The counsel for petitioner submits that Writ Appeal was dismissed for non-compliance of the common conditional order dated 08.11.2024, due to the mistake of office clerk. The counsel instructed the office clerk for removal of defaults and was under impression that the defaults are cured and matter would be listed for the hearing but the appeal stood dismissed on account of non-removal of defaults within stipulated period of time granted by the Court. He submits that the mistake is bonafide in nature and not intentional and simply a mistake of office Clerk. Therefore, in view of the above circumstances it would be appropriate in the interest of justice to restore W.A.No.2390/2023 to its original number for hearing.

In view of the above submissions made by the counsel for petitioner, W.A.No.2390/2023 is restored to its original number.

Petitioner shall cure the defects within one week, if any.

Accordingly, the MCC is disposed of.

Registry is directed to place the copy of this order along with the record of W.A.No.2390/2023.
