JABALPUR, India, Sept. 24 -- Madhya Pradesh High Court issued the following judgment/order on Aug. 25:
Learned counsel for the appellant submits that the appellant has been directed to submit a representation and it has been directed that the representation of the appellant be decided within 30 days of appellant joining the place of posting. Learned counsel further submits that in identical circumstances in Writ Petition No.24363/2025 by order dated 11.07.2025 it has been directed that the representation be decided within 30 days and pending consideration of the representation, stay has been granted to the petitioner therein. She submits that the facts of the case of appellant as well as the petitioner in Writ Petition No.24363/2025 are identical.
Issue notice.
Notice is accepted by learned counsel appearing for the respondents/State.
Considering the facts of the case of appellant as well as petitioner in Writ Petition No.24363/2025, as emanating from the respective orders, the impugned order dated 09.07.2025 is set aside.
The matter is remitted to the Writ Court to reconsider the petition particularly in light of the order passed in the case of identically situated petitioner i.e. Writ Petition No.24363/2025.
List the matter before the Writ Court for directions on 28.08.2025.
In the meantime, there shall be stay of the posting order.
With the aforesaid, appeal is finally disposed of.
