JABALPUR, India, Aug. 21 -- Madhya Pradesh High Court issued the following judgment/order on JUDGMENT/ORDER/RELEASE on July 21:
Applicants seek restoration of W.A.No.422/2025, which was dismissed in default vide order dated 07.07.2025.
It is stated in the application that the non-appearance of the counsel was bonafide and not deliberate and due to mistake on the part of the counsel party should not made to suffer. It is further submitted that since on 07.07.2025 the counsel for the appellant was busy at the Hospital and stuck in the road traffic due to heavy rains, he did not appear in the case and on 25.06.2025 also the counsel for appellant could not appear before this Court due to unavoidable circumstances, which was bonafide on part of the counsel for the appellant, however, the case was dismissed in default. It is prayed that in view of the above circumstances, it would be appropriate in the interest of justice to restore W.A.No.422/2025 to its original number for hearing.
From record, it reveals that on 07.07.2025 when the appeal was dismissed in default, later on the counsel had appeared and he was apprised of the order and he sought time to file an application for restoration.
In view of the above,W.A.No.422/2025 is restored to its original number.
Accordingly, the MCC is disposed of.
Registry is directed to place the copy of this order along with the record of W.A.No.422/2025.
