IMPHAL, India, May 1 -- Manipur High Court issued the following order on March 30:
Mr.E.Premjit, learned counsel for the petitioner submits that the petitioner, i.e. M/s Kanglei Society Development Organisation has been recommended by the Department of Social Justice, Government of India as agency for implementation of Comprehensive Rehabilitation of Persons Engaged in the Act of Begging under Support for Marginalised Individuals for Livelihood and Enterprise (SMILE), Imphal East, Manipur, however, fund for first instalment has not been released to the petitioner.
By the present petition, it is prayed that respondents be directed to release the first instalment for grant in aid to the petitioner. It is also further prayed that if the fund has been released to the private respondent No.5, the same may be recovered and released in favour of the petitioner.
Issue Notice.
Mr.W.Darakeshor, learned Sr.PCCG accepts notice on behalf of respondent Nos.1 and 2, Ms.Ch.Sundari, learned Government Advocate accepts notice on behalf of respondent No.3 and Mr.L.Raju, learned counsel accepts notice on behalf of respondent No.4.
Petitioner is directed to take steps for respondent No.5 by Speed Post within one week and file affidavit for proof of service.
Ms.Ch.Sundari, learned Government Advocate prays for taking instruction. However, Mr.Premjit, learned counsel for the petitioner submits that pendency of the petition shall not be a bar on respondents from releasing the first instalment of fund to the petitioner.
However, it is clarified that if fund for first instalment has been released to any third party, the same shall be recoverable subject to outcome of the writ petition.
