Heard Mr. S.K. Rath, learned counsel for the Petitioner and Mr. T.K. Dash, learned Additional Government Advocate for State-Opposite Parties. It is submitted that the original lawyer engaged by the Petitioner died since long and his associate could not pursue the case for his illness on the date of listing. It is further submitted that, present lawyer is engaged recently to conduct the case after dismissal of the writ petition and so the delay happened. Upon hearing both parties, the delay in filing the CMAPL is condoned and the CMAPL is allowed. The writ petition is restored to its original file. The I.A. and CMAPL are disposed of.
