PATNA, India, Nov. 24 -- Patna High Court issued the following judgment on Nov. 3:
Heard learned counsel for the parties.
2. The petitioner has filed the instant application for the following reliefs:
"a) For a direction to the Respondent No.3 to pass final order in the case bearing Appeal No.01/2024 which is pending for disposal from the date of 04.01.2024 to till date considering the merits of the case.
b) For issuance of any other writ/writs, direction/directions, order/orders in the ends of justice to which the petitioner is entitled."

The case of the petitioner in brief is that the matter relates to appointment of Anganwari Sevika in Anganwari Centre no. 153 in Gram Panchayat, Pagara, BlockDalsingsarai in the District of Samastipur. In the merit list prepared for appointment, while the respondent no. 8 was placed at the first position, the petitioner was placed at the second position. The challenge to the appointment of the respondent no. 8 by this petitioner was rejected by the District Programme Officer, Samastipur by his order dated 5.12.2023 against which the petitioner has preferred a revision before the Divisional Commissioner, Darbhanga.
4. Learned counsel for the petitioner submits that the instant application be disposed off with a direction to the Divisional Commissioner to dispose off the appeal filed by the petitioner within a reasonable time in accordance with law.

Having heard learned counsel for the parties and having perused the contents of the petition, without going into the merits of the case of the petitioner, the Divisional Commissioner, Darbhanga (respondent no. 3) is directed to decide the Appeal no. 1 of 2024 of the petitioner pending before him after hearing all the concerned parties including respondent no. 8 herein, in accordance with law, at the earliest preferably within a period of three months from the date of receipt of a copy of this order.
6. The application stands disposed off with the above observations and directions.
