PATNA, India, Sept. 1 -- Patna High Court issued the following judgment on Aug. 1:
The present writ petition is filed for the following reliefs:-
"(i) For issuance of writ of certiorari for quashing the part of the order dated 20.9.2017 contained in memo no. 9792 dated 20.9.2017 passed by respondent no. 1 (Managing Director, BSFC) whereby respondent no. 1 ordered to lodge F.I.R. upon the petitioner along with one Lal babu Jaiswal.
(ii) For the other reliefs which may be granted to the petitioner in the facts and circumstances of this case."
2. Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.
3. During the course of arguments, it is fairly conceded by the Leaned counsel for the respondent that he received the instructions from the department dated 26.07.2025 that no FIR was lodged against the petitioner till date.
4. Considering the fact that no FIR is lodged against the petitioner as on today, despite the order contained in Memo No. 9792 dated 20.09.2017 vide Annexure-9 by which the respondent no. 1 ordered to lodge an FIR against the petitioner in the year, 2017.
5. The petitioner is directed to file a detailed representation before the respondent no. 1/Managing Director, BSFC, Patna raising all his pleas and grievances with relevant documents within one month from the date of receipt of the order. In turn, the respondent no. 1/Managing Director, BSFC, Patna shall consider the representation, the relevant documents and after hearing the petitioner shall pass an appropriate order within three months from the date of filing of the representation.
6. With the abovesaid observation, the writ petition shall stand disposed of.
