PATNA, India, July 9 -- Patna High Court issued the following judgment on July 3:
Heard the parties.
2. In pursuant to the order of this Court dated 03.04.2025, a counter affidavit has been filed on behalf of respondent no.3.

It is categorically submitted that based upon the available documents/records, as also in view of the order of this Court, the services of the petitioner has been duly confirmed w.e.f. 11.01.1998 vide order as contained in Memo No.85, dated 19.06.2025, issued under the signature of Deputy Secretary, Government of Bihar (Health Department). It is further submitted that now the application of the petitioner will be placed before the Committee in the next ACP/DACP meeting and separate notification of ACP/DACP to the petitioner will be issued subsequently.
4. It is the admitted position that the petitioner is a hapless lady, aged about 77 years, and has been suffering from various ailments and is completely bed ridden. Now once the Government has taken a decision and her services has been confirmed w.e.f. 11.01.1998, there is no impediment in extending the benefit of ACP/DACP in accordance with the aforesaid decision.
5. It is expected that the entire exercise must be completed preferably within a period of three months from the date of receipt/production of a copy of this order and ensure payment of all the consequential arrears, salary/pension, including revision of pension in pursuant to 7th Pay Revision within the period stipulated hereinabove.
6. Failure to do so would certainly invite 6% penal interest over the delayed amount, till the same is paid to the petitioner.
7. With the aforesaid direction, the writ petition stands disposed off.
