PATNA, India, Sept. 29 -- Patna High Court issued the following judgment on Aug. 29:

Heard the parties.

2. The present application has been filed for initiation of contempt proceeding against the opposite parties for their willful and deliberate disobedience of the order dated 03.01.2025, passed in C.W.J.C. No. 19241 of 2024.

3. A show-cause affidavit has been filed on behalf of opposite party no.5. It has been informed to this Court that upon consideration of the materials and issues raised in Annexure-P/16 to the writ petition, Exhibit 5 of the Memo of charge of the Departmental Proceeding No. 19 of 2024, under Memo No. 2972 dated 05.08.2024, through which a pen drive carrying Video was examined by the Forensic Science Laboratory at Katihar; the Senior Scientist, FSL Katihar reported that since the origin of the Video is unavailable, it cannot be verified and thus Ext.-5 of the Departmental Proceeding No. 19 of 2024 has been directed to be deleted with an order to hold fresh enquiry.

4. Learned Advocate for the petitioner submitted that now both the Departmental Proceeding have concluded, but yet final decision has not been taken.

5. Having considered the submissions set forth by the learned Advocate for the respective parties, this Court does not find any reason or occasion to continue with the present proceeding.

6. Accordingly, the contempt proceeding stands closed.
