PATNA, India, Sept. 1 -- Patna High Court issued the following judgment on Aug. 1:
1. The writ petition is filed for the following reliefs:-
"A. A Certiorari for quashing and setting aside the order passed by the Sub-Divisional Officer, Patna City vide Memo No. 111 dated 22/2/2018 whereby and whereunder licence of the petitioner's Fair Price Shop bearing No. 129/16 has been cancelled contained in Annexure - 1.
B. A mandamus commanding the Respondents to restore the petitioner's licence as before and to make allotment for the petitioner's shop.
C. Any other relief or reliefs for which petitioner may be found entitled in the fact and circumstances of the present case may be granted to him."
2.During the course of the arguments, the Learned counsel for the petitioner seeks indulgence of this Court to grant liberty to file a representation before the authority and direct the authority to pass necessary orders duly taking into account the objections filed by the petitioner.
3.Without going into merits of the case, the petitioner is directed to file a representation before the authority within one month from the date of receipt of this order. In turn, the appropriate authority, i.e., District Manager, BSFC, Patna shall consider the representation and pass an appropriate order within three months from the date of filing of the representation.
4.With the aforesaid observations, the Writ petition is disposed of.
5. Interlocutory Application(s), if any, shall stand disposed of.
