PATNA, India, Oct. 15 -- Patna High Court issued the following judgment on Sept. 16:

Heard the parties.

2. The petitioners, who are 9 in numbers, have approached this Court for the following reliefs:

(i)For issuance of a writ in the nature of Mandamus or any other appropriate Writ/Order/Direction to the respondent authorities to consider the choice posting of petitioners against the posts of Head Master at Government Senior Secondary Schools according to the provisions of Senior Secondary Head Master Rules, 2021 and also according to the well-settled Principle of Migration of Meritorious Reserved Category Candidates as has been decided by Hon'ble Apex Court vide order/Judgement dated 07.05.2010 passed in Civil Appeal Nos - 4310-4311 of 2010 reported in 2010 (7) SCC 234 as-well-as a recent Order/Judgement dated - 07.02.2025 passed in C.W.J.C. No 1945 of 2022, passed by this Hon'ble Court.

(ii)Further, for issuance of a writ in the nature of Certiorary or any other appropriate writ/order/direction to quash/set-aside the order contained in Memo No 1616, dated 30.06.2025 issued by the Director, Primary Education, Education Department, Government of Bihar, Patna, whereby and whereunder the list of selected candidates with allotted district have been published without following the wellsettled principle of migration of Meritorious. Reserved Category Candidates. (iii)Further, for issuance of a writ in the nature of Mandamus or other any appropriate writ/order/direction to the respondents to stay the operation of order contained in Memo No 1616, dated 30.06.2025 (Annexure P/1) and further to stay the process of posting of Head Master at Government Senior Secondary Schools till final disposal of this writ application.

(iv) Further, for any other order/ orders as your Lordships may deem fit for that the petitioner may be found to be entitled to as per the facts and circumstances of the present case."
