PATNA, India, Sept. 17 -- Patna High Court issued the following judgment on Aug. 18:
Heard the parties.
2. The petitioner, upon being appointed as lecturer by Notification No. 668 dated 30.06.2020; has been working as a Senior Lecturer in Primary Teachers Training College, Mahendru, Patna, is aggrieved with the order contained in Memo No. 5314 dated 08.10.2024 issued by the respondent No. 2, whereby she has been deputed to District Institute of Education and Training, Arwal.
3. Prayer has also been made to post the petitioner in her original Primary Teachers Training College or any other suitable post in Patna, taking into consideration her pitiable condition, besides her unattended ailing mother-in-law and 12 years old son.
4. Mr. Suraj Narayan Yadav, learned Advocate for the petitioner submitted that the very deputation of the petitioner to the District Institute of Education and Training, Arwal, is actuated with malafide on account of the reason that she has made a complaint against the in-charge Principal of the Primary Teachers Training College, Mahendru, Patna before the Additional Chief Secretary, Education Department.
5. Learned Government Pleader No. 25 interjected the submissions and submitted that since the allegation has been levelled against the in-charge Principal, instruction is required by the concerned respondent authorities.
6. Be that as it may, considering the fact that for ventilating the grievance, the petitioner had already filed a detailed representation before the Additional Chief Secretary, Education Department, Government of Bihar, a copy of which is marked as Annexure- P/5 to the writ petition, for the ends of justice, this Court thinks it apt and proper to dispose off the writ petition with a direction to the Additional Chief Secretary,
Education Department, Government of Bihar to take up the representation as contained in Annexure- P/5 to the writ petition and bring to its logical conclusion after considering the averments made therein and taking into account her condition, as noted hereinabove.
7. It is expected that the aforesaid representation shall be considered and dispose off by passing a reasoned and speaking order, preferably within a period of six weeks from the date of receipt/production of a copy of this order.
8. Accordingly, the present writ petition stands disposed off with the aforesaid direction.
