PATNA, India, April 2 -- Patna High Court issued the following judgment on March 25:
The State has challenged the judgment dated 16.05.2024 passed by a learned Single Judge in CWJC No. 13895 of 2021 allowing the prayer made therein for a direction to the respondents to confirm and regularise their services with effect from 12th of October, 2018.
2. The writ petitioners/respondents are the contractual Drivers/Constables who were appointed by the Home (Police) Department in the year 2011. The appointment was made against the sanctioned vacant posts in the Bihar Police. The writ petitioners were initially selected for 11 months at the time of their appointment, which period was extended till 2021. Over a period of time, need was felt for more posts of Sepoy Drivers and Havaldars. In order to go ahead with the appointment process, Rule 1186 of Bihar Police Manual was amended and a relaxation of five years in the upper age limit was introduced for appointment to the post of Sepoy Drivers, who would have been working on contract basis from before. However, by the same amendment, the threshold academic qualification for the post was also changed from 10th pass to Intermediate pass or equivalent. It was also resolved that the Drivers appointed on contractual basis in the Police Organisation would get two additional marks for each years experience, subject to the maximum weightage of five marks. The writ petitioners were worried because of the effect of the amendment being made retrospective, making the writ petitioners/respondents also amenable to the raised threshold academic qualification.
