PATNA, India, Oct. 14 -- Patna High Court issued the following judgment on Sept. 15:
Heard the parties.
2. The petitioners have approached this Court for the following reliefs:
"(i) For issuance of a writ in the nature of Mandamus or any other appropriate writ or order for directing the respondents to consider and grant promotion to the petitioners on the post of Head Master from the date they have fulfilled the eligibility criteria as per Rule 8 of the Bihar Nagar Nikai Secondary and Senior Secondary School Service (Appointment, Promotion, Transfer, Disciplinary Proceedings and Service Condition) Rules, 2020.
(ii) For issuance of a writ in the nature of Mandamus or any other appropriate writ or order for directing the respondents to consider and grant promotion to the petitioners who are Secondary Teachers, on the post of Senior Secondary Teachers from the date they have fulfilled the eligibility criteria as per Rule 7 of the Bihar Nagar Nikai Secondary and Senior Secondary School Service (Appointment, Promotion, Transfer, Disciplinary Proceedings and Service Condition) Rules, 2020.
(iii) For issuance of any other appropriate writ, order or direction which Your Lordships may deem fit and proper in the facts and circumstances of the case."
3. After some argument, learned Advocate for the petitioners seeks permission to withdraw the present writ petition with a liberty to approach before the authority concerned by filing a fresh representation.
4. In view thereof, the writ petition stands disposed of with a liberty to the petitioners to approach before the authority concerned along with a fresh representation.
5. In case, such representation is filed by the petitioners, the same shall be considered and disposed off by passing a reasoned and speaking order preferably within a period of twelve weeks from the date of receipt/production of a copy of this order.
