PATNA, India, Nov. 24 -- Patna High Court issued the following judgment on Nov. 3:
Heard the parties.
2. The Petitioners, who were duly appointed to the post of Assistant Teachers in different Primary-cum-Middle Sanskrit School, are aggrieved with the action of the Respondents in not extending their salary, for which the petitioners have approached this Court by filing the present writ petition. It is specifically contended that despite the duties having been discharged by the petitioners, the petitioners have been deprived from their salary for ten and nine months, respectively. For redressal of the grievance, the petitioners have also approached before the District Education Officer, Madhubani, but to no avail, hence the present writ petition.
3. Learned Advocate for the Bihar Sanskrit Shiksha Board fairly submits that since the petitioners have already filed representation before the District Education Officer, Madhubani, who is the competent authority and shall look into the matter and pass the appropriate order.
4. Having considered the nature of the grievance and the submission advanced, the writ petition stands disposed of with a direction to the petitioners to file fresh representation before Respondent No.5 - The District Education Officer-CumDistrict Planning Officer, Madhubani, preferably within a period of four weeks from today. In case, such a representation(s) is/are filed the concerned Respondent shall look into the matter and pass appropriate order. Suffice it to observe, if the claim of the petitioners find favour necessary consequential monetary benefit must be given to them, preferably within a further period of eight weeks from the date of filing of such representations. 5. Writ petition stands disposed of.
