PATNA, India, Feb. 11 -- Patna High Court issued the following order on Jan. 12:

1. When the case was called out, none had appeared for the petitioner, however, the learned APP for the State, Mr. Jharkhandi Upadhyay, and the learned counsel for the O.P. No. 2 were present. Thereafter, a request was made by Shri Krishna Murari Prasad, learned counsel that this case may be heard after a few cases as his senior, Mr. Vijay Kumar Sinha was downstairs. When again the case has been called out, now Sri Krishna Murari Prasad submits that he wants time to seek instructions from his client.

2. The case has been filed in the year 2016. By order dated 13.09.2023, the case was referred for mediation and the mediation has failed. After getting interim protection on 13.09.2023, the petitioner chose not to appear in the mediation proceeding. It appears that the petitioner is not interested in pursuing the case but wants to linger the case.

3. The learned counsel appearing for the O.P. No. 2, at this juncture, has submitted that the petitioner is also not paying the maintenance.

4. In these circumstances, one last chance is given to the petitioner to appear before this Court tomorrow and pursue his case.

5. Re-list this case tomorrow i.e., on 13.01.2026 at 12:00 Noon.
