PATNA, India, May 29 -- Patna High Court issued the following order on May 1:

Heard learned counsel for the petitioner and learned APP for the State.

02. In the present case, the petitioner seeks bail in connection with Nimchandpura P.S. Case No. 30 of 2024 registered for the alleged offences under Sections 341, 323, 504, 379, 307/34 of the Indian Penal Code.

As per prosecution case, petitioner and other FIR named co-accused persons along with 4-5 unknown persons, making an unlawful assembly and variously armed, came to the house of the informant and tried to assault the son of informant. When the husband of the informant intervened, this petitioner hit him by iron rod on his head and on eyes. Thereafter, the petitioner and co-accused further assaulted the informant and her son. Co-accused persons also snatched the earrings and cash from the informant and her son.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Earlier the petitioner moved before this Court seeking anticipatory bail, but he has been arrested and the anticipatory bail petition was dismissed as withdrawn. Learned counsel further submits that the present case is counterblast of Nimchandpura P.S. Case No. 24 of 2024, which was registered under Sections 323, 341, 307, 379, 504, 506/34 of IPC for the occurrence of same date, in which the informant side brutally assaulted the petitioner and his family members and they have suffered a number of injuries. Learned counsel further submits that the parties are agnates and are having dispute with regard to certain land. The informant side also cut the crops standing the land of the petitioner. The petitioner is in custody since 08.01.2025 and charge-sheet has been submitted.

05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Begusarai/court concerned in connection with Nimachandpura P.S. Case No. 30 of 2024, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:

(i) One of the bailors will be a close relative of the petitioner. (ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
