GANGTOK, India, June 5 -- Sikkim High Court issued the following judgment/order on May 30:
Heard on I.A. No.01 of 2023, by which the Petitioner proposes to amend the instant Writ Petition by insertion of Paragraphs 61A to 61J in the averments portion, Paragraphs R(i) to R(xix) in the grounds portion and Paragraphs b(i) and (ii) in the prayers portion of the Writ Petition.
Learned Deputy Solicitor General of India objects to the Petition on grounds that the said application is nothing but dilatory tactics to delay the instant matter as the Petitioner was never granted temporary status by the competent authority of the Respondent as sought to be made out by insertions in the proposed amendments. That, the Petitioner failed to exercise due diligence when the Writ Petition was filed and failed to file the documents although the entire documents were available in the public domain. Accordingly, the Petition deserves to be dismissed.
I have given due consideration to the submissions advanced. Admittedly these documents were available in the public domain hence, in my considered view, for proper administration of justice, the amendment ought to be and is accordingly allowed.
Let the amended Writ Petition be filed within two weeks' from today.
