GANGTOK, India, June 5 -- Sikkim High Court issued the following judgment/order on May 9:
Heard on I.A. No.04 of 2025, which is an application under Order XXII Rule 3 read with Section 151 of the Code of Civil Procedure, 1908, filed by the Applicant No.1.
Learned Counsel for the Applicant No.1 submits that the Applicant No.2 has since passed on 12-04-2025 and he seeks to substitute the Applicant No.2, by his only surviving legal heir, i.e., his daughter Ms. Dikki Doma Sherpa.
Learned Counsel for the Respondent No.1 submits that she has no instructions in the matter.
Having heard Learned Counsel for the Applicant No.1, I am of the view that the Petition ought to be and is accordingly allowed.
The Applicant No.1 shall take necessary steps in this context. I.A. No.04 of 2025 stands disposed of accordingly.
List on 05-06-2025.
As prayed for by Learned Counsel for the Applicant No.1, let the amended Memo of Appeal be filed in the meantime.
