Heard Ms. S. Bhuyan, learned counsel for the petitioner. Also heard Mr. D. Borah, learned Standing Counsel, DRI for the respondent no.2.
The petitioner and her husband received summons to appear before the concerned authority in connection with the seizure of 9,014 kgs of poppy seeds and 11,90,000 sticks of cigarettes of foreign origin in connection with DRI Guwahati's Seizure Case No.14/CL/IMP/PS & CIG/DRI/GZU/2025-26 dated 24.09.2025.
It was earlier submitted on behalf of the petitioner that to her knowledge her husband has been summoned and that she has been living separately from him for more than one and a half years at Goalpara in the house of her mother along with her child.
The petitioner was granted interim bail vide order dated 23.03.2026.
The case diary has been received.
I have perused the relevant portion of the case diary, the petitioner, herein, though stated to be wife of the main accused is stated to be living separately from him with her minor child in her mother's house. Therefore, I am of the considered view that it is not necessary to cancel her interim bail. The investigation is also completed and has resulted in a final report.
In such view of the matter, the interim bail vide order dated 23.03.2026 granted to the petitioner herein is hereby made absolute subject to the conditions that:-
(i) She shall render cooperation to the further investigation, if any, and;
(ii) She shall be available to face the proceedings, if required, and;
(iii) She shall not hamper or tamper with evidence.
