AGARTALA, India, June 5 -- Tripura High Court issued the following order/judgement on May 4:
Heard Learned Senior Counsel, Mr. Bibhal Nandi Majumder assisted by Learned Counsel, Mr. Samrat Sarkar appearing on behalf of the petitioner. Also heard Learned GA, Mr. Kohinoor N. Bhattacharyya appearing on behalf of respondent Nos.1 to 8 and Learned Counsel, Mr. Agniva Chakrabarti appearing on behalf of respondent No.9.
It is the case of the petitioner that one departmental proceeding was initiated against him and when the departmental proceeding was pending, the petitioner filed a writ petition before this Court. It is also the case of the petitioner that prior to the initiation of departmental proceeding, he submitted one application for voluntary retirement from service as he sustained bullet injuries and was declared unfit by the authority. In the writ petition, this court directed for disposal of both the prayer of voluntary retirement and the pending appeal. After that, the appeal was allowed by the authority. Later on, his prayer for voluntary retirement was also accepted by an order dated 31.03.2025. Now, by the said prayer of acceptance of voluntary retirement, the present petitioner has filed this writ petition for quashing and setting aside the orders dated 19.03.2021 and 29.03.2021 along with prayer for granting Special Pensionary Benefit to the petitioner.
Issue notice upon the respondents.
Since Learned GA, Mr. Kohinoor N. Bhattacharyya appears and accepts notice on behalf of respondent Nos.1 to 8 and Learned Counsel, Mr. Agniva Chakrabarti appears and accepts notice on behalf of respondent No.9, issuance of formal notice is waived.
List the matter on 25.07.2026. In the meantime, the respondents may file their reply, if they so desire.
