AGARTALA, India, May 27 -- Tripura High Court issued the following order/judgement on April 27:
Heard learned counsel of both sides.
During hearing Mr. Raju Datta, learned PP submits that a petition for custody trial of the accused was filed by the Investing Officer on 28.02.2026 before the learned Special Judge, Khowai Judicial District. However, the same has not been disposed of till date.
As it appears, such petition has been pending for more than 1 and half months. In the order passed by the learned Special Judge dated 03.03.2026, there is no mention about filing of such petition by the Investigating Officer. Thereafter, the case was also taken up on 17.03.2026 and 31.03.2026 by the learned Special Judge, but there is no indication that any such prayer was pressed by the learned Special PP before the Court, nor has the Court passed any order on the said petition.
This Court, earlier in BA No.12 of 2026 directed all the District Courts to dispose of such petition for custody trial at the earliest, and preferably within 7(seven) days. However, despite the same, it appears that the matter is not being taken up seriously either from the side of prosecution or from the side of respondent.
Anyway, this bail application is being disposed of without any observation on the merits, with a direction to the learned Special judge to dispose of the said petition for custody trial within 7(seven) days from the date of receipt of a copy of this order. Liberty is given to the applicant to approach this Court again if he is aggrieved by any such order passed by the learned Special Judge on the said petition.
Return the LC record along with copy of this order immediately to the learned Special Judge.
